The rights of unionized employees to have present a union representative during investigatory interviews were announced by the U.S. Supreme Court in a 1975 case (NLRB vs. Weingarten, Inc. 420 U.S. 251, 88 LRRM 2689). These rights have become known as the Weingarten rights.

During the month of April every unit will be meeting to nominate persons for all elected union positions.  The democratic process works best when everyone participates, so I urge you to attend your unit meeting on a regular basis, but most especially over the next few months as nominations and voting takes places. 

This is your union, your support and involvement ensures that every voice is heard.

FairPoint Post-Cutover Status Report

Introduction
At midnight on January 30, 2009, FairPoint Communications Inc. (“FairPoint”) began a cutover from the Verizon Communications Inc. (“Verizon”) systems to new systems and processes developed by Capgemini. After completion of the cutover process, FairPoint started fully operating on the new systems on February 9. This cutover has been the subject of much scrutiny by the Maine Public Utilities Commission, the New Hampshire Public Utilities Commission, and the Vermont Public Service Board and Department of Public Service (“Regulators”) and their staffs (“Staffs”). This scrutiny has included the engagement of the Liberty Consulting Group (“Liberty”) to monitor the preparations for and execution of the cutover and the resulting operations since the cutover.

Per diem payments were taxed again this week, as well as some discrepancies with non valid checks.  The union is making every effort to correct these problems.

A listing of taxable and non-taxable travel and per diem expense allowances is available at the hall for the asking.

A Central Office Staff Craft position for the Rochester Lab - resumes are being accepted until the close of business on April 3, 2009 with a start date of April 20th.  Any questions, call Kathy McNeil at 603-437-6878.

With the warmer weather approaching, please be aware of children in and around roadways.  Outside techs - circle check your vehicle upon arrival as well as departure from your job site.  Safety involves all of us to take the time to ensure your safety as well as others. Remember, you’re a union member.  Union quality doesn’t cost, it pays.

The majority of timesheets, 401k and payroll challenges with Fairpoint have been pretty much resolved with few discrepancies pending.  If at any time you feel your payroll is incorrect, have the necessary documentation and dates available for your manager to investigate.  Follow up daily to ensure your payroll has been corrected.

 

Nominations for all union offices will commence in the month of April.  The interest has been overwhelming throughout the State.  Great participation creates great outlook.

 

The Collette Lemay Scholarship applications are now available at the hall as well as the union website.  Applications must be postmarked no later than April 30, 2009.

 Your participation in all aspects of union business can only do one thing.  Make this Local stand out.Remember, you’re a union member.  Union quality doesn’t cost, it pays.

Fairpoint has announced that it is suspending its’ dividend payments to its’ shareholders.  This decision will allow Fairpoint to add roughly $93 million annually to its balance sheet.  This is a wise business decision, which mirrors the testimony presented to the PUC’s in all 3 States by the Union’s financial expert.  We applaud this move, as it serves to strengthen Fairpoint’s cash reserves and adds to the flexibility and liquidity necessary to compete in the current economic environment.

The Union and the Company have reached agreement on boot reimbursement for those members who are required to wear the ANSI Z41 work boot.  Employees will be reimbursed up to $100 tax free annually for the purchase of work boots.  This Agreement is retroactive to year 2008.  For reimbursement, please submit your  receipt to your supervisor.  Any questions, call the union hall at 669-8657.

401k issues - The Company believes it has fixed the files that drive the 401k funding issues.  The correct amounts should be in the next payroll cycle.  The Company will be implementing a schedule as to when the arrears will be amended

to reflect the proper 401K values.  Additionally, the Company has established a trust fund and has deposited in the fund the estimated cash necessary to correct the current shortfalls in the 401K.  These funds are in an interest bearing account.  These funds will be deposited into the individual 401K accounts as the necessary adjustments are made.

Corporate profit sharing checks are scheduled to the paid out next Friday, March 13th.  The amount of the check will be $700.
